    Institutionalizing the Human Right to Science

    The human right to science has long been guaranteed by international law, yet it remains largely unexplored by human rights practitioners and scholars. In short, it pertains to the interests of every researcher, but also of everyone, to participate in the scientific enterprise (i) and to access to the benefits of scientific progress (ii), as well as to be protected against the adverse effects of science (iii). Following the recent multiplication of recommendations and comments on the right to science by various international organizations, the right has been re-discovered and scholarly interest has been rising ever since. In order not to approach the right as the cure to all ills of scientific innovation and emerging technologies, however, it is important that international human rights lawyers develop fundamental research on some of the important gaps remaining in the conceptual and normative framework of the human right to science. The present project proposes to address the most important of those: the gap pertaining to the institutional dimension of the right to science, i.e. the so-called 鈥渟upply-鈥� or 鈥渄uty-side鈥� of the right. There is very little clarity, indeed, about the identity of the right鈥檚 duty-bearers, but also, more generally, of its responsibility-bearers, whether they are national, infranational or international institutions and whether they are public or private, on the one hand. Nor do we know much about how to coordinate those different institutional duty-bearers and responsibility-bearers on a universal scale in order to ensure the required co-specification and co-allocation of their respective duties and responsibilities, on the other. Unlike what is the case for other human rights, indeed, the duties and responsibilities that arise under the human right to science are not only owed by every State or international organization to people under its (territorial or extraterritorial) jurisdiction, but ought also be regarded, this project argues, as collective human rights duties, i.e. duties and responsibilities those institutions bear together. The justification for their collective dimension resides in the universal scope of the public good of science, but also, by extension, in that of the standard threats to the interests in that good. This much sought-after, but rarely defined 鈥渋nternational cooperation鈥� pertaining to the human right to science is not only a condition of the feasibility of the protection of those interests against global threats, but also of the overall fairness of the burden on each of the duty-bearing States or international organizations of jurisdiction. This project proposes to explore the ways to institutionalize those duties and responsibilities of international cooperation relative to the human right to science, including through the creation of new international institutions if required. The project also aims to address three more specific institutional gaps: first, the domestic and international institutional implications of citizen science and of everyone鈥檚 right to equal participation in the practice and organization of science; second, the domestic and international institutional dimensions of the duties of anticipation of the benefits, but also of the (risks of) adverse effects of science, including duties of diligent precaution and prevention arising under the human right to science; and, finally, the institutional dimensions of the inclusion in the scope of the right of non-Western forms of knowledge. In light of the contemporary surge of practice and scholarship on the human right to science and of the general and specific institutional gaps identified therein, the project鈥檚 outcomes should be of utmost scientific relevance. Moreover, qua project in fundamental legal research whose method includes, as in this case, both accounting for and guiding the practice of law, this project鈥檚 scientific relevance is indissociable from its practical impact on the laws that institute, promote and curb science. That impact will be enhanced by the association of human rights practitioners and 鈥渟cience diplomacy鈥� actors in the project鈥檚 conferences and publications. More generally, and beyond the law, it is difficult to think of a topic that could be of a higher political, but also social and economic relevance today than the question of the domestic and international institutionalization of equal access to scientific innovation and of the anticipation of its risks and benefits for humanity.

    The Sources of International Law

    The research project The Sources of International Law pertains to how international law is made today, i.e. by which processes its rules (provided they are rules) become rules of international law (provided it is law), and thereby acquire legal validity. Sources are a central question in international law, both in practice and theory. Not only is it important for practitioners to be able to identify valid international legal norms and hence the specific duties that stem from international law, but also the topic has great theoretical significance. Clarifying it helps understanding the nature of international law itself, i.e. the legality of international law. Furthermore, accounting for the sources of international law means explaining some of the origins of its normativity, as well as discussing potential justifications for its authority and the exclusionary 鈥渞easons to obey鈥� which it places on its subjects, and hence its legitimacy. Although and, probably, because it is one of the key questions in international law, the identification of the sources of international law also remains one of the most controversial ones in international legal scholarship. Moreover, law-making is one of the areas of the practice of international law that has changed most radically over the last 50 years, and since the list of sources of international law of Article 38 Statute of the International Court of Justice (ICJ) was last revised in 1945. It is not surprising therefore that international lawyers feel the need every so often, and even more often recently, to revert to it, to take stock and to provide an in-depth and general assessment of contemporary international law-making. The present project aims at doing exactly that. Qua umbrella-project, it proposes to do so in two-ways: first, and foremost, through organizing the edition and publication of the Oxford Handbook on the Sources of International Law that has just been commissioned by Oxford University Press to the applicant and her co-editor, Prof. Jean d鈥橝spremont (Universities of Manchester & Amsterdam) and, secondly, and more generally, through launching companion-research on specific aspects of the question by a doctoral student and a post-doctoral researcher. Oxford Handbooks are designed to offer authoritative and state-of-the-art surveys of current thinking and research in a particular subject area. The preparation and publication of such a handbook on the question of sources of international law provides the occasion to review the state of the theory of sources in international law and to take a fresh look at some of its old chestnuts and even identify new challenges. The Oxford Handbook on the Sources of International Law will be the very first comprehensive edited reference work devoted to the question of the sources of international law. It aims to provide an accessible and systematic overview of key issues and debates about the sources of international law. It also purports to offer an authoritative theoretical guide for anyone studying or working within, but also outside international law wishing to understand one of its foundational questions. The Oxford Handbook will feature 48 original essays by leading international law scholars and theorists from a range of traditions, nationalities and perspectives, in order to reflect the richness and diversity of scholarship in this area. Its specificity and novelty will lie not only in the broad range of theories represented, but also in its dialectical approach between the two chapters addressing each topic and in its strong jurisprudential or philosophical emphasis. Besides its general scientific impact in international legal scholarship, both doctrinal and jurisprudential, and its importance for the practice of international lawyers, the project will also contribute to the consolidation of doctoral and post-doctoral research in international law and, in particular in international legal theory, in Swiss law schools.

    Le pr茅sent projet de recherche a pour objectif de proposer une interpr茅tation de l鈥檃rt. 52 (1) de la Charte des droits fondamentaux de l鈥橴nion europ茅enne (芦 la Charte 禄). Cette disposition 茅nonce les conditions auxquelles l鈥檈xercice d鈥檜n droit ou d鈥檜ne libert茅 peut 锚tre restreint. Issue de la jurisprudence de la Cour de justice de l鈥橴E (芦 CJUE 禄), elle-m锚me fond茅e sur les pratiques nationales en la mati猫re et la Convention europ茅enne des droits de l鈥檋omme (芦 CEDH 禄), l鈥檃rt. 52 (1) de la Charte compl猫te la pratique existante en mati猫re de restriction des droits fondamentaux en y important des 茅l茅ments issus des crit猫res de restriction des droits contenus dans la CEDH tels qu鈥檌nterpr茅t茅s par la Cour europ茅enne des droits de l鈥檋omme (芦CourEDH禄), d鈥檜ne part, mais aussi des 茅l茅ments enti猫rement nouveaux, d鈥檃utre part. L鈥檌nterpr茅tation de l鈥檃rt. 52 (1) de la Charte demeure cependant encore ouverte, et la CJUE ne s鈥檈st qu鈥檈ncore tr猫s peu risqu茅e 脿 l鈥檃ppliquer. Outre la complexit茅 morale li茅e 脿 la restriction d鈥檜n droit fondamental en principe prioritaire sur tout autre int茅r锚t ou consid茅ration morale et les difficult茅s philosophiques qui s鈥檈nsuivent, les difficult茅s proprement juridiques sont en effet multiples. Fort de ce constat, le projet de recherche propose une lecture de l鈥檃rt. 52 (1) de la Charte qui soit 脿 la fois normativement correcte, corresponde 脿 la nature et au r么le des droits fondamentaux de l鈥橴E et respecte l鈥檈xigence de coh茅rence, requise par l鈥檃rt. 52 (3) de la Charte, avec la jurisprudence de la Cour europ茅enne des droits de l鈥檋omme (芦 CourEDH 禄) en mati猫re de restriction des droits de la CEDH. Fond茅 sur une analyse comparative jurisprudentielle et doctrinale, le projet de recherche se veut aussi empirique et prospectif, prenant particuli猫rement en compte le contexte europ茅en actuel. Aucune analyse de compatibilit茅 des crit猫res mat茅riels de restriction contenus dans la Charte et la Convention n鈥檈xiste 脿 ce jour. Or, au vu de l鈥檃vancement des n茅gociations sur l鈥檃dh茅sion de l鈥橴nion europ茅enne 脿 la CEDH et du contr么le de conventionalit茅 qu鈥檈lle instaurera, le projet de recherche permettra d鈥檕ffrir aux juridictions de contr么le, tant nationales que supranationale et internationale, un outil susceptible de faciliter une application coh茅rente de l鈥檃rt. 52 (1) de la Charte et de limiter les divergences interpr茅tatives avec la CEDH. Une telle approche permettrait 茅galement d鈥檃ssurer une meilleure mise en 艙uvre des droits fondamentaux contenus dans la Charte dans les Etats membres de l鈥橴E.

    Le module de formation doctorale (MF ProDoc), Fondements du droit europ茅en et international, a pour objectif de d茅velopper en Suisse la recherche fondamentale et interdisciplinaire sur les fondements du droit international et en droit europe麓en et ceci gr芒ce 脿 un encadrement rapproch茅 des th猫ses de doctorat et 脿 l鈥檕rganisation d鈥檜n certain nombre d鈥檃ctivit茅s telles que colloques doctoraux, s茅minaires-bloc, rencontres annuelles, s茅minaires d鈥檃ppui, enseignements et conf茅rences sp茅cialis茅s, ainsi qu鈥檜n groupe de discussion. Il vise 脿 prodiguer aux doctorants une formation fondamentale essentielle 脿 mener 脿 bien un projet de recherche de qualit茅, d鈥檜ne part, et de l鈥檃ide dans la pr茅paration de leur insertion professionnelle dans le milieu acad茅mique, d鈥檃utre part. Plus largement, le programme doctoral propos茅 devrait permettre non seulement d鈥檈ncourager la r茅daction de th猫ses de doctorat de haute qualit茅, mais aussi de fournir une contribution importante 脿 la recherche scientifique en suscitant une r茅flexion encore lacunaire mais n茅cessaire sur les fondements tant philosophiques que politiques, 茅conomiques, historiques ou sociologiques des ordres juridiques d茅velopp茅s au-del脿 des fronti猫res 茅tatiques que sont les ordres juridiques international et europ茅en.

    La Cour europ茅enne des droits de l鈥檋omme apr猫s le Protocole 14 - Premier bilan et perspectives

    Le 1er juin 2010, le Protocole 14 脿 la Convention europ茅enne des droits de l鈥檋omme est finalement entr茅 en vigueur apr猫s plusieurs ann茅es d鈥檌ncertitude. Ce Protocole apporte un certain nombre de r茅formes importantes et d茅sormais connues au fonctionnement de la Cour, r茅formes qui devraient permettre de corriger certaines des difficult茅s et retards accumul茅s 脿 ce jour. L鈥檈ntr茅e en vigueur apporte n茅anmoins son lot de questions puisque nombre de points proc茅duraux et mat茅riels n鈥檕nt pas pu 锚tre r茅solus par la mise 脿 jour du R猫glement de la Cour et devront recevoir une r茅ponse en pratique. Par ailleurs, comme l鈥檃vaient annonc茅 de nombreux sp茅cialistes, de nombreuses autres r茅formes sont requises afin de rendre la Cour plus efficace et le Protocole 15 est d茅j脿 en discussion. Cette conf茅rence aura pour objet tout d鈥檃bord de faire le point sur l鈥檈ntr茅e en vigueur du Protocole et tirer un bilan d鈥檜ne premi猫re ann茅e de fonctionnement de la Cour dans ce nouveau cadre en identifiant les points qui doivent encore 锚tre am茅lior茅s. Il s鈥檃gira ensuite de reprendre la question d茅sormais permanente de la r茅forme de la Cour 脿 l鈥檃une de la D茅claration et du Plan d鈥檃ction adopt茅s 脿 l鈥檌ssue de la Conf茅rence d鈥橧nterlaken sous l鈥櫭ゞide de la pr茅sidence suisse du Conseil de l鈥橢urope le 19 f茅vrier 2010. Diff茅rents points du Plan d鈥檃ction seront examin茅s et diff茅rentes suggestions seront faites.

    Le projet est un projet de recherche bilingue fran莽ais-anglais consacr茅 脿 l鈥櫭﹖ude non seulement de la nature d茅mocratique de la politie europ茅enne, mais aussi de son impact sur la validit茅 et la l茅gitimit茅 du droit europ茅en. Il s鈥檃git donc 脿 la fois d鈥檜n projet en th茅orie politique et d鈥檜n projet en th茅orie du droit. Si la question de la d茅mocratie europ茅enne a d茅j脿 fait l鈥檕bjet de nombreuses 茅tudes, sa relation aux questions difficiles qui entourent la nature et la structure de l鈥檕rdre juridique europ茅en n鈥檃 pas encore 茅t茅 beaucoup explor茅e. Il ne s鈥檃gira pas, en effet, ici uniquement de consid茅rer les modalit茅s juridiques du fonctionnement d茅mocratique de l鈥橴nion europ茅enne (UE), mais plut么t la nature et l鈥檌mpact de ce fonctionnement sur la cr茅ation du droit de l鈥橴E et son application dans les Etats membres. L鈥檌nverse est aussi vrai ; la th茅orie d茅mocratique europ茅enne ne s鈥檌nspire que rarement de l鈥檕rganisation pratique des m茅canismes de production du droit europ茅en et de sa mise en oeuvre en droit national. Il est difficile, en effet, de se pencher sur les d茅tails souvent tr猫s techniques du fonctionnement de la proc茅dure l茅gislative, de la d茅l茅gation l茅gislative et de la mise en oeuvre du droit de l鈥橴E par les institutions de l鈥橴E, mais aussi par ses Etats membres. La question est particuli猫rement actuelle dans la mesure o霉 le Trait茅 modificatif de Lisbonne sign茅 le 13 d茅cembre 2007 introduit un certain nombre de principes d茅mocratiques dans les trait茅s fondateurs et notamment le principe de l鈥櫭ゞalit茅 politique, de la d茅mocratie repr茅sentative et de la d茅mocratie participative. M锚me si ces principes sont g茅n茅raux et non-justiciables, d鈥檃utres nouveaut茅s plus concr猫tes doivent 锚tre mentionn茅es et notamment l鈥檌nitiative citoyenne europ茅enne, qui permet 脿 un million de citoyens de d茅poser une initiative l茅gislative aupr猫s de la Commission europ茅enne, et le renforcement du r么le des parlements nationaux dans le processus l茅gislatif europ茅en. Si la question du d茅ficit d茅mocratique a 茅t茅 explor茅e ad nauseam par les milieux scientifiques depuis le d茅but des ann茅es 1990 et si l鈥櫭ヽhec du Trait茅 茅tablissant une Constitution pour l鈥橢urope a remis en cause une bonne partie du discours constitutionnel europ茅en, ces nouveaux d茅veloppements rappellent que la question politique des fondements de la l茅gitimit茅 du droit de l鈥橴E est encore loin d鈥櫭猼re r茅solue. Et ceci appelle un r茅examen de la question 脿 la lumi猫re des le莽ons 脿 tirer des d茅bats constitutionnels des trois derni猫res ann茅es et une discussion de la pratique 脿 suivre dans les Etats membres pour que ces nouveaux instruments de la d茅mocratie europ茅enne soient porteurs de la l茅gitimit茅 complexe dont a besoin la politie europ茅enne. Enfin, la question est particuli猫rement int茅ressante en Suisse, o霉 avec ou sans int茅gration l鈥檌mpact du droit europ茅en se fait ressentir sur les institutions et processus d茅mocratiques internes. L鈥櫭﹖ude plus approfondie des rapports entre d茅mocratie et droit dans un ordre juridique sui generis int茅gr茅, mais pluraliste comme l鈥檕rdre juridique europ茅en est fondamentale pour bien comprendre la l茅gitimit茅 actuelle et future du droit suisse. La voie bilat茅rale qui a 茅t茅 formellement choisie par nos autorit茅s nous apporte certes le confort d鈥檜n processus intergouvernemental de l茅gislation par trait茅 et comit茅 mixte, mais sa l茅gitimit茅 d茅mocratique ne saurait longtemps 锚tre assur茅e par de telles proc茅dures vu l鈥檃mpleur et la profondeur des changements l茅gislatifs apport茅s. Il s鈥檃gira donc de voir comment l鈥檕rdre juridique suisse peut b茅n茅ficier des changements li茅s 脿 la d茅mocratisation des processus europ茅ens et trouver une voie propre qui correspond aux attentes politiques de Bilat茅rales. Ce projet de recherche est un des premiers modules de recherche du ProDoc Ecole doctorale sur les fondements du droit europ茅en dont la requ茅rante principale est aussi la requ茅rante du pr茅sent projet.

    Le module de formation doctorale a pour but de d茅velopper la recherche fondamentale dans le domaine des 茅tudes juridiques europ茅ennes en Suisse romande gr芒ce 脿 l鈥檈ncadrement rapproch茅 des th猫ses de doctorat, 脿 l鈥檕rganisation de colloques des doctorants bisannuels, d鈥檈nseignements sp茅cialis茅s, de s茅minaires d鈥檃ppui et de groupes de discussion. Les 茅tudes juridiques europ茅ennes sont, comme d鈥檃ucuns s鈥檈n 茅tonnent souvent, un des points forts des Facult茅s de droit helv茅tiques. Du point de vue de la recherche doctorale, cependant, il n鈥檈xiste pas ou plus de structures existantes dans ce domaine en Suisse et notamment en Suisse romande, d鈥檕霉 l鈥檌nt茅r锚t du projet propos茅. L鈥橢cole doctorale romande en 茅tudes europ茅ennes de l鈥橧nstitut europ茅en de l鈥橴niversit茅 de Gen猫ve (IEUG), financ茅e par le Triangle Azur depuis 2003, prend fin en 2008. Avec l鈥檃ccord de tous les partenaires, le ProDoc en reprendrait les fondements en l鈥櫭﹍argissant aux autres universit茅s de Suisse romande et en la relocalisant 脿 Fribourg du fait notamment de son Institut de droit europ茅en et de sa situation privil茅gi茅e au coeur de la Suisse. Le ProDoc Ecole doctorale romande sur les fondements du droit europ茅en permettrait de cr茅er un p么le d鈥檈xcellence doctoral dans le domaine du droit europ茅en autour des quatre universit茅s romandes que repr茅sentent les requ茅rants (Prof. Samantha Besson et Prof. Pascal Pichonnaz pour Fribourg ; Prof. Nicolas Levrat pour Gen猫ve ; Prof. Evelyne Clerc pour Neuch芒tel ; et Prof. Andreas Ziegler pour Lausanne) et de leurs universit茅s partenaires en Suisse et 脿 l鈥櫭﹖ranger. Les Universit茅s de Fribourg, de Neuch芒tel, de Lausanne et de Gen猫ve disposent toutes d鈥檌nstituts renomm茅s dans le domaine des 茅tudes europ茅ennes : c鈥檈st le cas dans le domaine des 茅tudes europ茅ennes interdisciplinaires pour l鈥橧nstitut europ茅en de l鈥橴niversit茅 de Gen猫ve, dans le domaine du droit europ茅en pour l鈥橧nstitut en droit europ茅en des Universit茅s de Berne, Fribourg et Neuch芒tel (BENEFRI) bas茅 脿 Fribourg et dans le domaine du droit 茅conomique europ茅en et international pour le Centre de droit compar茅, europ茅en et international (CDCEI) de l鈥橴niversit茅 de Lausanne. Ces universit茅s et instituts ont une longue tradition de recherche fondamentale en droit europ茅en et c鈥檈st dans l鈥檌d茅e d鈥檈n faire b茅n茅ficier leurs doctorants qu鈥檈lles soumettent ce projet. Le MAS en 茅tudes europ茅ennes de l鈥橧EUG, le Consecutive Master in European 糖心Volg de l鈥橴niversit茅 de Fribourg et le MAS/LLM en droit international et europ茅en de l鈥櫭ヽonomie et des affaires de l鈥橴niversit茅 de Lausanne sont trois exemples de la qualit茅 de la formation dans ces institutions et de leur aptitude 脿 former de futurs doctorants en 茅tudes europ茅ennes et participants au ProDoc. Les cinq professeurs requ茅rants sont actifs dans le domaine de la recherche sur les fondements du droit europ茅en, soit dans le cadre de la recherche historique et comparative (p.ex. 茅tude du droit commun romain, puis du droit priv茅 europ茅en et compar茅 pour le Prof. Pichonnaz), soit dans le cadre de la recherche philosophique et politique (p.ex. 茅tude des sources, de la nature et de la l茅gitimit茅 de l鈥檕rdre juridique europ茅en pour la Prof. Besson ou 茅tude du r茅gionalisme et du f茅d茅ralisme europ茅ens pour le Prof. Levrat), soit enfin dans le domaine des fondements 茅conomiques du droit europ茅en (p.ex. droit des march茅s publics et de la concurrence europ茅ens pour la Prof. Clerc et droit commercial et des affaires europ茅en pour le Prof. Ziegler).

    What is the relationship between European law and international law? Is European law a special brand of international law? In case of conflict, whose norms should take priority? What does that mean in national law terms? These are just some of the many questions all international and European lawyers have once wondered about. Interestingly, those questions have become popular again among European legal scholars after a series of recent decisions by the Court of First Instance of the European Communities raising the question of the validity and rank of international law duties in the European legal order. In international law, as well, the emergence of transnational normative hierarchies in the human rights context and, more generally, the so-called constitutionalization of international law have thrown new light onto the relationship between the European and international legal orders. The conference aims at taking stock of those recent developments to try to find new answers to old questions.

    PEOPEL is an interdisciplinary research project funded by the Swiss National Science Foundation in the framework of the programme "SNSF Professorship". The project aims at developing a philosophy of law that can explain European law in its post-national and poly-centered specificity, on the one hand, and a philosophy of law that is truly European and not only German, French or Anglo-American, on the other. Hence the idea of a European philosophy of European law.

    Le projet European Law online a pour objectif la r茅alisation de cours de droit europ茅en sur internet. Ces cours sont fond茅s sur des 茅l茅ments r茅alis茅s par des enseignant-es de plusieurs universit茅s (cf. ci-dessous) selon un plan modulaire commun. Ils sont ensuite assembl茅s dans le cadre de cours adapt茅s 脿 la langue, au programme et au niveau de connaissance des 茅tudiant-es des diff茅rentes univesit茅s. Ces cours sont int茅gr茅s dans le programme Campus virtuel suisse (leader: Universit茅 de Fribourg) et dans le r茅seau Campus num茅riques fran莽ais (leader: Universit茅 Robert Schuman). Dans un avenir proche, les cours European Law online seront 茅galement diffus茅s sous la forme d'un programme de master en ligne.
