Biografie

Seit 2020 an der Universität Freiburg. Davor Fellow am Merton College und Associate Professor in dem Philosophie Department der Universität Oxford, sowie Bersoff Assistant Professor und Faculty Fellow an dem Philosophie Department der New York University. Er arbeitet zur Ethik, Metaethik, politischen Philosophie, Entscheidungstheorie und Metaphysik, sowohl in systematischer als auch historischer Hinsicht.

    Im ersten der beiden Teile seiner "Metaphysik der Sitten", den "Metaphysischen Anfangsgr眉nden der Rechtslehre", trifft Kant an mehreren Stellen die Aussage, 盲usserlicher Besitz 鈥撀燿.h. Besitz an Gegenst盲nden, die mit ihrem Besitzer nicht notwendigerweise physisch verbunden sind 鈥� sei im Naturzustand zwar m枚glich, gelte dort aber nur "provisorisch". Mit seiner Idee eines im Naturzustand zwar potentiell wirklichen aber zugleich nur provisorischen Rechts setzt sich Kant zum einen von Thomas Hobbes als Vertreter eines Naturzustandsmodells ab, bei welchem das Recht als solches dem staatsbegr眉ndenden und somit naturzustands眉berwindenden Sozialvertrag 眉berhaupt erst entspringt, wendet sich jedoch gleichzeitig gegen eine Naturzustandsvorstellung im Sinne John Lockes, gem盲ss derer wir im Besitz nat眉rlicher und als solcher bereits im Naturzustand bestandskr盲ftiger gegenseitiger Rechte sind und insbesondere der rechtm盲ssige Erwerb von Eigentum an 盲usseren Gegenst盲nden bereits im Naturzustand m枚glich ist. Kants Konzeption des Naturzustandes, und hierdurch indirekt sein Rechtsverst盲ndnis als solches, markiert somit eine philosophisch zumindest potentiell 盲usserst bedenkenswerte Position. Bis vor kurzem war jener Position insbesondere in der internationalen philosophischen Debatte nichtsdestotrotz vergleichsweise wenig Beachtung geschenkt worden, so wie sich insgesamt erst in j眉ngerer Zeit auf breiter Ebene die Erkenntnis durchgesetzt hat, dass die Rechtslehre einen Bestandteil des kantischen Korpus von bedeutendem philosophischem Eigenwert bildet. Inzwischen formiert sich jedoch eine lebhafte Debatte dar眉ber, wie die Idee des provisorischen Rechts bei Kant zu verstehen ist, welche Stellung sie in Kants weiterer Rechtstheorie einnimmt und inwiefern sie unser systematisches Verst盲ndnis dessen, was den Begriff des Rechts ausmacht, voranbringen k枚nnte. Genau zu jener Debattenformierung soll der internationale Workshop an der Universit茅 de Fribourg, zu dessen Finanzierung ich das vorliegende Gesuch einreiche, einen massgeblichen Beitrag leisten. Der Workshop wird im Pr盲senzformat Ende August an zwei Tagen 脿 f眉nf Sitzungen pro Tag stattfinden. Amtssprache des Workshop ist durchweg englisch. Bei den zehn Referierenden, welche allesamt bereits definitiv zugesagt haben, handelt es sich um in der Schweiz, Deutschland, dem Vereinigten K枚nigreich, den Vereinigten Staaten, Argentinien und Neuseeland angesiedelten Forschenden. Die Geschlechterbalance ist mit vier weiblichen und sechs m盲nnlichen Vortragenden ann盲hernd ausgeglichen. Alle Vortragenden sind ausgewiesene Expertinnen und Experten zu Kants Rechtslehre. Mehrere davon haben bereits zum provisorischen Recht bei Kant publiziert. Gemeinsam mit einer kleinen Auswahl zus盲tzlicher Texte zum selben Thema sollen die Workshopvortr盲ge anschliessend in einem Sammelband erscheinen, welchen ich gemeinsam mit einem der Teilnehmenden, Micha Gl盲ser, herauszugeben vorhabe. Als Verleger des Sammelbandes zielen wir auf einen international f眉hrenden akademischen Verlag ab. Bei der Akquise der entsprechenden Ver枚ffentlichungsvereinbarung werden wir so vorgehen, dass wir die Abstracts unserer intendierten Sammelbandbeitr盲ge als Expos茅 geb眉ndelt den zust盲ndigen Verlagslektorinnen und -lektoren vorlegen. Die Einreichung der Abstracts wird bis Ende Februar erfolgen. Das Expos茅 werden wir zeitnah nach Eingang aller Abstracts erstellen und verbreiten, mit dem Ziel, den Verlagsvertrag zum Zeitpunkt des Workshop bereits abgeschlossen zu haben. Die Zusammenstellung des Sammelbandes w眉rde sich voraussichtlich in der ersten Jahresh盲lfte 2026 vollziehen, so dass der Sammelband 2027 erscheinen d眉rfte. Sinn und Zweck des Sammelbandes ist es, die derzeit f眉hrende Forschung zum provisorischen Recht bei Kant in einer einzelnen Publikation zusammenzuf眉hren, welche der sich zu diesem Thema entwickelnden Debatte zuk眉nftig als prim盲rer Bezugspunkt dienen soll. Sinn und Zweck des Workshops, welchem das vorliegende Gesuch gilt, ist es wiederum, die Autorinnen und Autoren der einzelnen Sammelbandbeitr盲ge in einen Dialog miteinander zu bringen, mit der Absicht, den Sammelband selbst so weit wie m枚glich als ein Forum genuinen wissenschaftlichen Austauschs zu gestalten.

    Enlightenment and Publicity: The problem of deception in late 18th-century political and religious thought

    鈥淓st-il utile au people d鈥櫭猼re tromp茅, soit qu鈥檕n l鈥檌nduise dans de nouvelles erreurs, ou qu鈥檕n l鈥檈ntretienne dans celles o霉 il est?鈥� The 1780 prize question published by the Berlin Academy constitutes the starting point of the research project. This question problematises the difficult relationship between deception and enlightenment and represents a turning point in the German Enlightenment. Although deception would seem to be antithetical to enlightenment, the views on the usefulness of deception, prejudices and superstitions upheld by many Enlightenment authors are rather complex and many did not support the immediate and complete 鈥榚nlightening鈥� of the people, either favouring actively deceiving the people or at least letting them retain their prejudices and superstitions. This research project will examine this relationship from three different perspectives: Enlightenment: This strand examines how the enlightenment (Volksaufkl盲rung) is to be conceptualised, arguing that an important shift was effected by the prize question, concerning who is part of the public that is to be enlightened, what the anthropological underpinnings are of the enlightenment and what strategies are to be employed to further the enlightenment of the people. Publicity: This strand addresses the relationship between enlightenment and deception in political thought, focusing on Immanuel Kant鈥檚 principle of publicity. It examines how publicity is to be construed, how the requirement of compatibility with publicity can be justified and whether this principle applies in the same way in the international setting as it does in the domestic setting. Religion: Drawing on the early modern and Enlightenment critiques of religion as deception, this strand investigates strategies of 鈥渕aking use鈥� of (potentially) deceptive forms of religion (superstition, prejudice, enthusiasm) by focusing on Kant鈥檚 theory of religion, and particularly his conception of 鈥渉istorical faith鈥� and its political purport. Together these different strands will examine the central aspects of the problem of deception that the 1780 prize competition brought to centre-stage, shedding light on the nature and limits of enlightenment and the ways in which deception can be used for enlightenment as well as for political and religious purposes. By focusing on the difficult and ambivalent entanglement of political and religious goals, it will contribute to the critical reappraisal of the late Enlightenment.

    The fundamental question of political philosophy is whether there should be a state at all. This question arises because states are coercive. States utilise force as well as the threat of force to make those who are within their territory comply with the laws that they have promulgated. Explaining how they can permissibly do so is necessary for justifying the state. First, one needs to show how and under what conditions the state is justified in using coercion. Second, one has to justify the monopoly on coercion, explaining on what grounds the state occupies a privileged position so that it can forbid others from likewise using coercion. And, third, one needs to provide an explanation of the territorial dimension of the state, justifying how the state comes to occupy this privileged position with respect to a particular territory. Each of these tasks is fraught with difficulties. The coercion on the part of the state runs up against the liberty and autonomy of individuals. The monopoly on coercion requires one to introduce an asymmetry amongst moral equals, granting powers and permissions to some that others do not have. And, finally, the territorial nature of the state requires one to draw boundaries that exclude those who are outside them. These difficulties put substantial pressure on the idea that states can ever be justified. The project Authority and Territory aims to address these challenges by systematically developing a novel Kantian justification of the state. It argues that the state is not optional but morally necessary and, correspondingly, that the state need not be based on consent but can permissibly be established and maintained by coercion. By developing a distinctively normative assurance problem, it offers a reconceptualisation of the fundamental problem that makes the state necessary in the first place. In particular, it shows why the state of nature is, from a normative perspective, a condition of war and correspondingly why the state is necessary in order to establish a condition of peace in which interactions are rightful. As a result of reconceptualising the Kantian approach to political obligation in terms of a natural duty of peace, rather than in terms of the traditional natural duty of justice, it manages to particularise political obligation on the part of individuals and to establish the territorial aspect of the state, thereby showing how authority on the part of the state can be particularised and how the boundary problem can be solved within a functional account.

    Re-examining Anarchy, State, and Utopia

    Robert Nozick's Anarchy, State, and Utopia (1974) is a classic of 20th Century philosophy that has had a huge impact on moral and political philosophy and that is still widely discussed and taught nowadays. The objective of the proposed conference 'Re-examining Anarchy, State, and Utopia', is to offer a reappraisal of Nozick's contributions to moral and political philosophy. It will provide a forum for leading contemporary thinkers to re-engage with Nozick's pathbreaking work, allowing them to evaluate in what ways Nozick's book has helped to shape moral and political philosophy over the course of the last 50 years and to assess its lasting significance and relevance, identifying which of Nozick's arguments and contributions have stood the test of time. The papers will be published in an edited volume entitled 'Nozick's Anarchy, State, and Utopia at 50' in 2024 by Cambridge University Press, edited by Ralf Bader.
